Looking at these pictures you would say he is OUT.  Gracjan has the ball in, and you can just see the runner coming into frame on the second shot.  In the third shot Gracj is making the tag, but in the 4th picture the umpire signals SAFE.  The Pro Image Photographer on the other side of the field  shows a better shot where you could see that the ump was right.
